Izvleček:The general objective of this thesis is to analyze the emerging special contract and the violation of labor rights and principles in the Ecuadorian legislation. In times of the world health crisis of the Covid-19, in order to counteract unemployment and employers to separate workers from their work centers, the Organic Law of Humanitarian Support (LOAH) was dictated in which a new type of labor contract was established, such as the special emerging contract whose term of duration is a defined time, which brings with it labor flexibilization, which causes a violation of labor rights and principles, causing a regression of labor rights. It is a legal dogmatic research with documentary review of the regulations in force in the country, whose methods were análisis - synthesis, inductive - deductive, abstract – concrete and historical - logical. Finally, the selected techniques were the review of scientific texts of the last five years that are in indexed databases, books and scientific articles that address the violation of the right to work were consulted, as well as the review of national regulations and comparative law, which allows to have as main result that this type of contract violates labor rights and principles; which constitutes a regression of the conquests for labor rights.
