In the critical legal analysis carried out, we examine how the loss of the right to freedom applies to those sentenced for this crime, comparing Ecuadorian legislation with that of other countries, based on the stated objective: Carry out a critical legal analysis, to the light of comparative law, about the loss of the right to freedom of the convicted person, in the crime of illicit association. The analysis suggests that Ecuadorian legislation, like in other countries, faces the challenge of balancing the fight against organized crime and the protection of the fundamental rights of the individual. The loss of the right to liberty in the context of illicit association must be evaluated judiciously, avoiding abuses and guaranteeing due process that respects the dignity of those sentenced. The review of international regulations and experiences could enrich the Ecuadorian approach in this area.
