Sumari:The De facto union in Ecuador has been legally recognized since the 2008 Civil Code reform, granting cohabiting couples access to a community property regime similar to that of marriage. There are practical difficulties, particularly in notarial formalization and the protection of property rights. The objetive of this study is to analyze the role of the notary in the formalization, regulation, and dissolution of these unions. A mixed-methods approach was applied with documentary analysis, interviews with notaries, and a comparative study with the legislation of Spain and Colombia. The results show misinformation, regulatory gaps, and inequality compared to marriage, especially in inheritance matters. Notaries identify deficiencies in the regulation and a lack of knowledge among cohabiting couples. It is concluded that the notarial role is fulfilled according to he law, however, notarial procedures should be improved and the legal education should be promoted.
