Summary:The Constitution recognizes indigenous justice as a mechanism for the resolution of internal conflicts, including those related to violence against women. However, disadvantages have been identified in the struggle for the eradication of violence in indigenous communities that maintain cultural patterns of subjugation of women. It is analyzed how, in the processing of offenses against women, the acceptance of the declination of competence excludes the active participation of the victim, without guaranteeing her integral reparation. The methodology applied is exploratory, based on the analysis and examination of the problem in the declination processes in relation to the protection of women. In addition, a documentary and bibliographic review was used, complemented with the application of surveys to legal professionals specialized in criminal matters. The results show a tension between indigenous justice and the right of women to the eradication of violence and comprehensive reparation. Regulatory reform of the declination process in cases of gender violence is recommended.
