Summary: | In Ecuador, the action for protection is a constitutional guarantee that seeks the direct and effective protection of the violation of rights recognised in the constitution and international norms, the correct application of and respect for the constitutional principles protected in the Constitution. With the aim of designing a document of critical legal analysis on the correct interposition of the action for protection in Ecuador, a non-experimental research with a qualitative approach was developed. Using the synthetic analytical method. The empirical method of case analysis was applied to the correct filing of the action for protection and its impact on legal security. The protection action filed by the taxi company "Los Pendoneros" located in the canton of Otavalo was analysed. In the analysis of this case, we found a violation of rights perpetrated by the Autonomous Decentralised Government of Otavalo, the violation of constitutional rights, principally the right to work and with it the violation of various rights enjoyed by Ecuadorians. Based on this critical analysis of the current regulations related to the action for protection, a critical legal document is proposed for the correct interposition of the action for protection in order to guarantee both its nature and legal security. |
