Summary:The jurisprudence of the Inter - American Court of Human Rights in observance of Article 23 of the American Convention on Human Rights (Pact of San José, 1969) has established that the removal of popularly elected authorities cannot be imposed by bodies of an administrative nature. However, in Ecuador it has become evident that the General Comptroller of the State, when exercising its sanctioning power, orders the dismissal of this kind of authorities. Therefore, the scientific problem posed was "Why does the removal of popularly elected authorities, ordered by the Office of the comptroller, constitute a violation of the right to due process? The general objective of the research was "To develop a critical legal analysis on the administrative dismissal ordered by the Comptroller General of the State to popularly elected aut horities, as a form of violation of the right to due process", linking as a technique to the methodology was used documentary and bibliographic analysis, obtaining a clear overview of the problem, its repercussions, and possible solution in reference to th e application of the principle of direct application of international human rights instruments by administrative authorities, as provided for in the Constitution of the Republic.
