Análisis comparado de la responsabilidad penal en la distribución de pornografía generada con inteligencia artificial

ABSTRACT This research addresses the growing problem related to the generation and distribution of pornography through the use of artificial intelligence tools. This type of content is disseminated on various websites, causing various harm to the victim. With this premise, the main objective of this research is to carry out a comparative study of Ecuadorian legal regulation in contrast to the legislation of countries such as South Korea, Spain and China, in order to mitigate pornographic crimes generated by artificial intelligence. The article aims to raise awareness about this problem and encourage an informed debate about the need to regulate and prevent the production and circulation of unauthorized images generated by artificial intelligence systems. To achieve these objectives, theoretical methodologies were used, specifically synthetic analysis, which enables the breakdown of the information collected on artificial intelligence. In addition, the doctrinal legal method was used, which involves examining and interpreting relevant legal regulations. Among the main conclusions obtained is the fact that society is not fully aware of this new problem, which urges legislators to intervene effectively to regulate the misuse of artificial intelligence.
