סיכום:The research deals with the Proportionality of Criminal Sanctions for Illicit Fuel Trafficking in Ecuador: Legal Analysis and Reform Proposals to Article 266 of the Comprehensive Organic Criminal Code, with the general objective of designing a critical analysis document on the proportionality of criminal sanctions imposed in Ecuador for illicit fuel trafficking, with special emphasis on cases of offenders who transport small quantities, in order to identify possible legal reforms that guarantee effective and equitable criminal justice. For a better analysis of the research as indicated by the methodology was divided into 3 moments; Theoretical conceptual foundation is developed by the theoretical framework in which the theoretical bases, comparative law and doctrine of the problem investigated, in turn this moment was divided into 6 moments in the first the introduction to the theoretical framework such as the context and relevance of the subject, subsidies, borders, corruption, smuggling, diversions, transportation, strengthening and cooperation; in the second the doctrinal and normative foundations; In the third, an analysis of important rulings; in the fourth, regulatory gaps and implementation problems; in the fifth, proposals for legal reforms; and in the sixth, conclusions. Within the Methodology to be Used section, the methodological framework was addressed, detailing the instruments and techniques used, as well as the development of the questionnaire and survey, in addition to the analysis of the three cases and the feasibility it grants to the proposal through the results. Within the Proposal section, the critical analysis document on the proportionality of criminal sanctions imposed in Ecuador for illicit fuel trafficking was addressed, with special emphasis on cases of offenders transporting small quantities, in order to identify possible legal reforms that guarantee effective and equitable criminal justice.
