| Резюме: | The study analyzes the relationship between the principle of publicity within notarial activity and the right to personal data protection in the Ecuadorian legal system. The general objective of this research is to analyze the principles of publicity and data protection in the Ecuadorian Notarial System in order to ensure that notarial publicity does not violate individuals' rights to privacy and personal data protection. A qualitative approach was applied to deeply investigate how legal practice develops, is exercised, and coexists with the legal norm regarding the right of publicity in the notarial field and the Data Protection Law within the Ecuadorian Legal System. For this purpose, a review of normative texts and doctrinal works, as well as an analysis of jurisprudence and notarial practice in Ecuador, was conducted. As a result of interviews with experts in the notarial field, it was found that the principle of publicity is fundamental to ensuring transparency and legal certainty; however, in practice, the limits established for the protection of personal data are not always respected, due to a lack of knowledge of appropriate protocols to safeguard the privacy of those involved in notarial acts, which can lead to unauthorized disclosure of sensitive information. It is concluded that the principle of publicity must be carried out under strict controls to ensure the proper handling of confidential information. |
