Description
Summary:This article studies the potential feasibility of implementing blockchain to contribute to the chain of custody of digital and documentary evidence in the Ecuadorian criminal procedural system. The main issue is the vulnerability while handling the evidence during judicial procedures, such as tampering, loss, or disruption of tracking, which directly affects the integrity of the judicial process. Blockchain is presented as an innovative tool that has the potential to ensure unchangeable, transparency, and security of evidence. Thereby increasing public trust in the justice system. The methodology applied in this study is based on literature review, interviews with qualified informants in the new field of Information and Communication Technologies, as well as experience gathered from other countries. The analytical, inductive, and exegetical methods were used to interpret the data and assess its potential use in the Ecuadorian context. The results show that blockchain can improve the custody and handling of evidence by providing an undeniable record of each interaction with the evidence, thus increasing traceability and control over its use.
