Özet:In this scientific article, the compliance or non-compliance of the principle of parity in the judicial processes of regulation of the visitation regime in Ecuador was investigated. The study was based on a qualitative approach, using interviews with key informants and subject matter experts to gain a detailed understanding of the problem. Non-probabilistic sampling based on cohabitation was applied to select participants, thus allowing for close and relevant data collection. The investigation revealed that, despite the clear guidelines established by the Ecuadorian regulatory framework for the application of the principle of parity, judicial practice faces various problems regarding equal access to justice. These include the influence of unconscious biases, inequalities in resources and capabilities between parents, and high levels of conflict between them. These factors complicate the effective implementation of the principle of parity in the regulation of visitation rights. The results highlight the need for thorough and adaptive judicial management to ensure that the parity principle is applied fairly and equitably. It is crucial that judges handle these challenges with an approach that prioritizes the best interests of the child, tailoring decisions and procedures to the specific circumstances of each case to ensure effective and equitable visitation regulation.
