Description
Summary:Notarial Law is one of the key branches of law related to document management, where notaries and their staff provide public faith and legal validity to the acts performed in their offices. However, offenses may also lead to serious legal consequences. The general objective of this study is to analyze the offenses that notaries and their employees may commit while exercising notarial functions. The methodology employed is theoretical, based on documentary review and legal analysis, using a qualitative approach with a descriptive scope. The results led to an analysis of the legal framework, establishing that notarial service is a profession with multiple responsibilities, involving not only trust but also the extent of its actions. It was concluded that, since the State is responsible for ensuring proper service, greater oversight is required to prevent irregularities that could undermine justice. This includes implementing external audits, a comprehensive digital system, and the creation of stricter regulations adapted to the Ecuadorian context to avoid legal loopholes or injustices.
