La facultad legal del registrador de la propiedad para cancelar de oficio una inscripción

This article addresses the problem related to the legal restriction faced by the Property Registrar in not being able to act ex officio in cases of cancellation of the registration of a real estate property, as well as the lack of clear procedures for each type of cancellation. According to the provisions of Article 53 of the Registry Law, this authority will only proceed with the cancellation if it is at the request of an interested party or by court order. This situation undoubtedly violates the principle of celerity, since it delays the processes in the registry entity. The main objective of this research is to examine the content of the aforementioned article 53 and the powers of the Property Registrar with regard to the cancellation of property registrations. In order to carry out this analysis, a qualitative methodology has been chosen, which allows a descriptive, explanatory and propositive approach. Given the problems affecting the process of cancellation of registrations in the Property Registry, it is essential to address this situation by creating an ordinance that allows the Property Registrar to cancel the registration automatically in specific cases, such as a change of territorial jurisdiction. At the same time, clear and efficient rules should be established to regulate these procedures and define the necessary deadlines for their processing.
