This work is significant because it analyzes the possibility of streamlining the processes of transferring parental rights through notarial means, which could decongest the judicial system and prioritize the best interests of the child. Additionally, it proposes a regulatory reform that would allow these legal acts to be handled through extrajudicial channels, with the aim of promoting the effective application of procedural and constitutional principles such as simplification, celerity, and procedural economy. |

Este estudio evalúa las facultades y alcances del notario ecuatoriano en la solemnización de la cesión voluntaria de la patria potestad. La investigación emplea una metodología cualitativa, con un enfoque dogmático-jurídico y aplicado, utilizando métodos teóricos como el análisis-síntesis y la inducción-deducción, junto con una exhaustiva revisión documental y un estudio comparado del derecho. Este trabajo es significativo porque analiza la posibilidad de agilizar los procesos de cesión de patria potestad a través de la vía notarial, lo que podría descongestionar el sistema judicial y priorizar el interés superior del niño.
