Čoahkkáigeassu:The relationship between informed consent and the principle of confidentiality within the framework of Ecuador’s Organic Law on Personal Data Protection (LOPDP) highlights the importance of these principles in protecting personal data, emphasizing their foundation in the Ecuadorian Constitution and current legislation. The general objective is to explain that the informed consent signed by the data subject must warn, that storage may be compromised in its security and that it would affect the principle of confidentiality. A qualitative methodology with a descriptive and analytical approach was used, utilizing documentary analysis and expert interviews. The results show that, although the LOPDP requires informed consent, its practical application is deficient, with generic consent and a lack of effective measures to protect confidentiality. The conclusions emphasize the need to include warnings about security risks in informed consent to reinforce the protection of confidentiality.
