要約:The research focuses on the critical analysis of the regulation of the empty chair citizen participation mechanism in the canton of Portoviejo, Ecuador, in relation to the principle of legal security. The Ecuadorian Constitution recognises both the right to legal security and citizen participation as fundamental elements. Decentralised autonomous governments have the power to issue ordinances, but the regulations in Portoviejo canton have limitations, such as restrictions on the topics and lack of sanctions for non-participation. This contrasts with broad and transparent regulations in other cantons such as Cuenca and Quito. The research adopts a qualitative approach with a non-experimental design describing theory and documentary analysis, addressing descriptive, analytical-explanatory and propositional features. Analytical-synthetic and inductive- deductive methods will be used to analyse the regulations from the Constitution to the municipal ordinances, contrasting them with the principle of legal security, under a system approach to integrate all the sections of the scientific article. The general objective is to carry out a critical legal analysis of the regulation of the citizen participation mechanism of the empty chair in Portoviejo and its impact on the constitutional rights of citizen participation against the principle of legal security, with the proposal of a draft reform project to improve the regulation and guarantee more effective citizen participation in accordance with constitutional principles.
