El tratamiento de datos personales en el divorcio de mutuo consentimiento y el principio de confidencialidad

The present academic work called THE TREATMENT OF PERSONAL DATA IN DIVORCE BY MUTUAL CONSENT AND THE PRINCIPLE OF CONFIDENTIALITY, its line of research corresponds to Notarial and Registry Law and its relevance as a guarantee of truthfulness n legal acts; the essential objective of this article is to evaluate the violation of the principle of confidentiality due to inadequate treatment of personal data by the notary in the notarial divorce. The paper begins by outlining the definition of divorce by mutual consent and its evolution in Ecuadorian legislation, then it is introduced in relation to the protection of personal data, and the principle of confidentiality in notarial proceedings. It is determined hat the activity of the notary in the treatment of data at the time of divorce by mutual consent s transcendental in order not to break the principle of confidentiality and its derivations in erms of its responsibility in the different spheres. The methodological design is based on qualitative and dogmatic-legal criteria to investigate the treatment of personal data by the notary at the time of divorce by mutual consent considering the application of the principle of confidentiality. Qualitative methods are used, documentary analysis as it is a review article. The first result obtained is the importance of the notary's actions at the time of divorce by mutual consent in order not to violate the protection of users' data, in addition to the proper application of the principle of confidentiality.
