| Sumari: | This research is entitled: "The need to criminalize obstetric violence for violating the right to reproductive health in pregnant women, prior to prevent and eradicate violence against women", since it deserves to be studied to solve and overcome the socio-legal problems identified in the Organic Integral Penal Code the lack of classification of obstetric violence within the crimes of violence against women and members of the family. Obstetric violence is caused when violence against women and abuse of power by the health professional over the pregnant woman are combined. This is the type of violence exercised by health personnel or health professionals on women's bodies and their reproductive health, pregnancy, childbirth and postpartum, through dehumanizing treatment, abuse of medications, which can be both physical with invasive practices and unjustified medicalization, and psychological, with humiliating and disrespectful treatment and omission of information. Obstetric violence is totally invisible, due to general, criminal, social, machismo, prejudice, lack of knowledge and lack of information for women and the general population. Obstetric violence has been naturalized and made invisible by both health professionals and pregnant women. Most women easily identify situations of obstetric violence during childbirth and postpartum care practices; however, health professionals do not consider these practices as violent. Materials and methods were also applied to develop the present research, as well as interviews and surveys, which were used to propose a legal reform project in the Organic Integral Penal Code, to guarantee the rights of pregnant women during pregnancy, childbirth and postpartum who are victims of obstetric violence in health centers. |
