| Summary: | This thesis entitled "The Penology and its impact on the modification of the offense according to the amount of drugs seized", wants to show that the current penalties imposed on offenders for the crime of smuggling of controlled substances, not consistent with the constitutional principle of proportionality by not stopping the commission of this crime in the country, being necessary to consider penology as independent science of criminal law knows the imprisonment to be imposed on processed immersed drug offenses or controlled substances. The current scale of sanctions that typifies the Code of Criminal Integral does not contribute to eradicate trafficking and illicit trade in narcotic drugs and psychotropic substances, requiring that these penalties are modified considering the amount of drugs seized in the operation or detention. The theoretical, legal and doctrinal gathering, conducting surveys and interviews yielded widely recognized criteria clear and precise basis of literature, which contributed to the verification of the objectives and the testing of the hypothesis concerning this practice; both the Constitution of the Republic of Ecuador, as the Code of Criminal Integral criminalizing the penalties for the crimes of trafficking controlled substances, with their respective penalty must be proportionate to contribute to the prevention of the commission of other crimes and let people enjoy a public safety and the rehabilitation of those indicted for crimes in narcotic drugs and psychotropic substances. |
