Zusammenfassung:The thesis represents a real contribution to Civil Litigation theoretical, because it is developing a new theory that will allow banish the habit of preventing the denial of paternity or paternity of a child, through DNA testing as a means evidence within the process, thus being able to reliably determine the true right to the identity of the child or adolescent. Translating our theory to practice procedural achieve an effective practice of the right to challenge paternity through DNA testing as an effective form of evidence in the process of affiliation and in turn, be guaranteed the right to an identity that is inherent the child or adolescent, guaranteed in our Constitution and international instrument. All theoretical contribution as ours is a scientific novelty pointing towards the strengthening of the security of every human being to confirm with actual evidence, parenthood that will give rise to a relationship of sonship with rights such as food, but that if negative results from DNA testing, can not be subject to an obligation to a pedigree that does not exist, while be guaranteed in this way the right of children and adolescents to recognize their true identity
