Then with the labor reform, you opt for the oral system, which is what we go through today, but our current system faces another big problem of administration of justice, the claims of labor rights, has tripled, but the units court of Civil, Commercial and Toil in our environment, few remain, so that the oral system has also become slow. Referring specifically to my research goal, I was able to locate and focus to propose a labor reform as instantly to be sentencing within the labor process, based on the study of the fundamental principles of the Constitution of the Republic of Ecuador, Ecuadorian approved by referendum, and duly published in the Official Gazette, in which legal content of Art. 168 provides that the administration of justice shall be governed by principles, including those principles, at number six, that "the conduct of the processes all the materials, steps and proceedings will be conducted through oral system (...) "the bold and italics are mine. Then it is necessary to examine briefly the Legislative Body, drafted this statutory provision, to be generally applied to all the materials, but not only in criminal matters, Childhood, and others, I refer specifically to these areas because that is where it is applied with fullness orality. It is evident, that would be violated this constitutional provision, in applying Art. 583 of the Labour Code, which states that within ten days the judge will rule on any business processes rather opt for saying that applies a mixed system, which is the oral and verbal summary, note that the process begins with the current oral procedure and to end the legal battle, has sentencing term, returns the old system was the verbal summary.

Luego con la reforma laboral, se opta por el sistema oral, que es el que atravesamos en la actualidad, pero este sistema, enfrenta otro gran problema de administración de justicia, los reclamos de los derechos laborales, se han triplicado, pero las Unidades Judiciales de los Civil, Mercantil y Laboral en nuestro medio, siguen siendo pocos, es así que, el sistema oral también se ha tornado lento. Refiriéndome específicamente a mi objetivo de la investigación, he podido localizar y enfocarme para proponer una reforma laboral en cuanto al instante que se debe dictar sentencia dentro del proceso laboral, basada en el estudio delos principios fundamentales de nuestra Constitución de la República del Ecuador, aprobada mediante referéndum ecuatoriano, y debidamente publicada en Registro Oficial, en cuyo contenido legal del Art. 168, dispone que la administración de justicia se regirá por principios, entre aquellos principios, en el número seis, dispone que “La sustanciación de los procesos en todas las materias, etapas y diligencias se llevará a cabo mediante el sistema oral, (…)”1las negrillas y subrayado es mío. Entonces es preciso analizar brevemente que el Órgano legislativo, elaboró esta disposición legal, para ser aplicada generalmente a todas la materias, más no, solo en materia penal, Niñez, y otros, me refiero específicamente a estas materias por cuanto es allí donde se aplica con plenitud la oralidad.
