| Crynodeb: | In the Code of Childhood and Adolescence establishes the socio-educational measures that will be applied to those adolescents who commit or are linked to any crime that is against the law. The Code of the Childhood and Adolescence in the referred in its article 385 numeral 2 subsections A, B, C and D textually points out "ART. 385. - Application of socio-educational measures in offenses sanctioned in the Code Comprehensive Criminal Penalty .- The socio-educational measures applicable to offenses sanctioned in the Integrated Criminal Code are: 2. For cases of offenses punishable by a custodial sentence of more than five years and up to ten years, the reprimand measure and one of the following measures shall be applied: A. Home stay from six months to one year. B. Six-month-to-one-year weekend internment C. Internment with semi-open regime of six months to two years. D. Institutional internment from one to four years. Having analyzed the legacy provisions mentioned above we can realize that there is no adequate specialized sanction for those adolescents who have committed or are linked with the crime of murder. 5 These rules mean that teenagers who commit murder do not have a real rehabilitation, because considering the time established in numbers A, B, C and D is not enough for the adolescent to have a real rehabilitation |
