Sumari:This study investigates the legality of the use of force in protests in Ecuador, focusing on the effectiveness of the existing legal and jurisprudential framework. The research reveals a significant evolution in the constitutional protection of the right to protest, but identifies a persistent gap between this theoretical protection and its practical application during crisis situations. The analysis covers multiple aspects, including the criminalization of social protest, the effectiveness of accountability mechanisms as well as the control of the State in situations of protests. It is observed that, despite jurisprudential advances, practices of criminalization of protest persist based on the voices of the authorities, thus generating a series of challenges in the effective implementation of protocols for the proportional use of force. Based on these findings, the study proposes a series of recommendations. These include the development of clearer protocols for the use of force, the strengthening of human rights training programs, the implementation of independent monitoring systems, and the promotion of more effective dialogue between authorities, security forces and civil society.
