Several interviews with judges and prosecutors were conducted in order to demonstrate this point, as well as statistical data collected from the National Service of Integral Attention to Adult Deprived of Liberty and Adolescent Offenders in order to obtain the real figures of the number of inmates in the penitentiary centers, as well as their legal situation and the overcrowding in the facilities. As a result, it was found that there is a deliberate application of pretrial detention by justice operators, since there is no due observance of the principles of due process, causing prisons to be overcrowded, largely due to what is known as prisoners without a sentence. Key words: Preventive Detention, Prison Overcrowding, Precautionary Measures, Administration of Justice.Las cárceles ecuatorianas, se encuentra atravesando la peor crisis debido al hacinamiento que existe, en gran parte como consecuencia de la inadecuada aplicación de la prisión preventiva, llegando a ser uno de los mayores problemas sociales que se enfrenta en la actualidad. El presente trabajo es una investigación sobre este problema, a fin de determinar si el hacinamiento carcelario es causado como repercusión de la prisión preventiva por parte de los administradores de la justicia. Con el fin de demostrarlo se realizaron varias entrevistas a Jueces y fiscales y también se recolectó los datos estadísticos del Servicio Nacional de Atención Integral a Personas Adultas Privadas de la Libertad y a Adolescentes Infractores, a fin de conocer las cifras reales de la cantidad de internos que se encuentran en los centros penitenciarios, además de su situación jurídica y el hacinamiento existente. Como resultado, se obtuvo que existe una deliberada aplicación de la prisión preventiva por parte de los operadores de justicia, ya que no hay debida observancia a los principios del debido proceso, causando que las cárceles se encuentran sobre pobladas, gran parte por lo que se conoce como los presos sin sentencia.
