Adicionar Tag | Resumo: | The work is one of the oldest activities of mankind, which we access all in order to earn enough for our subsistence, labor rights of workers in Ecuador, during the course of time, have been violated by a reduction of working hours which brings about a decrease in the unified basic salary, face this kind of problem facing the Ecuadorian worker, it is necessary that the authorities in which this responsibility to solve and protect all their rights, taking into account seriously the case that in their plans and policies should perform their duties as public officials, the problem that threatens the life and dignity of the subject, both as a worker, as a human being. This research addresses the problem of "DECLINE OF SALARY WITH LESS HOURS OF MINDFUL WORK AGAINST ECONOMIC STABILITY OF WORKER in which a doctrinaire and legal analysis of the issues raised is performed, in which we have posed a general objective is to study, critical, and legal doctrine regarding the reduction of wages shorter working hours as a factor that threatens the economic stability of the worker. And three specific ones that are to determine which exists in the labor legal regime infringement of the rights of workers, with reduced wages with fewer hours of work; demonstrate the dispute between the Constitution and the Labour Code in relation to the right of the worker to receive a basic salary unified which is affected with the reduction of working hours, the same as they were delimited with the investigation of countryside. 5 The theoretical treatment of this research consists in the first relevant phase with the literature review, which began conceptualizing and analyzing in detail as regards the definition of labor and employment law as fundamental categories of the study, which concerning the minimum wage and the worker as the main body. Concluding with a legal reform bill that determines effective to perform the job guarantee, so you can not reduce the base salary of the employee, even when working hours decrease. |
