Summary:In this thesis I make an assessment of the problems arising in society and the media from the effective date of the Communications Law, which iniciare stating that the legal concept of the media lynching laid down in Article 26 hinders the media causing a contradiction to civil liberties enshrined in the Constitution as the right to Freedom of Expression. To fulfill the objectives proposed proceeded to make a critical, doctrinaire, theoretical and policy analysis which could establish the elements of the media lynching and develop a comparative study with other legislation and demonstrate the violation of a constitutional right as Freedom Expression and be able to raise a proposal for removing this legal figure in the Communications Law. For legal foundation will draw me as the main norm in international treaties and conventions, the Constitution, the Code of Integral Criminal, the Communications Law, the Ecuadorian Civil Code, which establish that the media lynching violates a constitutional right as is the Freedom of expression. I have done a fieldwork based on surveys and interviews conducted thematic experts such as journalists, media lawyers and free exercise giving me a broad knowledge regarding the current situation of freedom of expression in our country. To obtain reliable information I have applied several methods that have helped me to investigate particular situations on the media lynching and consequences associated with this legal figure in the media law which is violated a constitutional right such as freedom of expression the same that according to a chronological study of the various constitutions of the Ecuadorian State and the review of international treaties distintitos we can determine that freedom of expression was the first law established throughout the world for democracy there. After extensive research we can conclude that the media lynching is a means to restrict the dissemination of information by submitting the performance of individuals, giving personal and direct way to a constitutional right like freedom of expression.
