Sammanfattning:This curricular integration project titled “Compliance with the 1954 Convention on Diplomatic Asylum: Evaluating State Discretion in Classifying Criminal Acts and and Motives for Persecution,” aims to assess the effectiveness of the Convention in safeguarding the rights of its member states. Specifically, the study is conducted to respond to the need to evaluate how states interpret and classify criminal acts or grounds for persecution within the context of diplomatic asylum, emphasizing the importance of ensuring fairness and transparency in the asylum process. The findings of the study indicate that, while the 1954 Convention is seen as a critical instrument for safeguarding sovereignty and preventing external interference, there is a significant need to clarify the distinction between political and common crimes. The current ambiguity in this classification limits the effective protection of Member States and challenges the integrity of the asylum process, as the classification of the crime is often influenced by political factors. In addition, the study emphasizes the importance of maintaining the inviolability of embassies, concluding that any search must be legally authorized and approved by the relevant diplomatic representative. It is important to emphasize that this curricular integration project provides a comprehensive analysis of legal information from descriptive, evaluative, explanatory and propositional perspectives. The research project is developed using a range of materials and methods. In particular, interviews and surveys are conducted with legal professionals. As such, the findings aim to promote a critical perspective on the classification of crimes in the context of diplomatic asylum, examine its implications for state sovereignty, and reinforce the need for transparent and equitable processes.
