Sumari:This thesis took place because the Civil Code currently provides for two kinds of divorce by mutual consent (Art. 106 of the Civil Code) and contested divorce on grounds (Art. 110 of the Civil Code). The disadvantage that one spouse by disagreements that are not in Article 110 of the Civil Code Surge, like divorce, can not do for lack of legal norm in our country. My proposal is the possibility that it can incorporate a clause in Article 106 of the Civil Code to allow one spouse to spouse sue the voluntary agreement, ie, it is one spouse to the other expressing their desire to divorce and the other spouse is acknowledged who must respond to such a claim at the same hearing. In response researched and demonstrated the need for the Civil Code Article 106 be amended to allow unilateral divorce will.
