According to the Constitution of the Republic of Ecuador, and international instruments signed by the Ecuadorian government, life, health and personal integrity are fundamenta lhumanrightsthat must be protected through clear rules, previous, and public, in accordance with the principle of legal certainty in force in the Constitution. However, this securityis not verifiedeffectively inthe case ofMandatoryTraffic AccidentInsurance, as rules that regulatethe Organic LawofLand Transport,Traffic and Road Safety, and itsGeneralImplementing Regulation,noare sufficient toensurethe operabilityof this insurancecoverageswellestablishedat presenthave no relation tothehigh cost ofmedical services, which require victims ofsuch accidents. The above describedproblemis addressed inthis research, presented as pre-qualification as a lawyer,which is calledrequirement: "REFORMINTHE ORGANIC LAWOFLAND TRANSPORTATION, TRAFFICAND ROAD SAFETY, THEOPERATIONOFSOAT, ASGUARANTEEDTO THE RIGHTOF CITIZENS INTRAFFIC ACCIDENTSINECUADOR". In this studyan analysis of the problem described aboveispresenting conceptual, doctrinaland legal elementsina theoreticalcollectionrelated to the theme, plus the results ofa research processof fieldnotes, to finally makethe approach of alegal proposalto amend theLaw onLand Transport,Traffic and Road Safety, as well as its GeneralImplementing Regulation,in orderto ensure the operabilityof the CompulsoryTraffic AccidentInsurance, and seektheirhedgesare efficientto coverexpensesto be performedvictims oftraffic accidentsor their relatives,and aimto contribute and help over come the unfortunateconsequences ofthese mishapsis achieved.
