Hiring of public works, contributes to the development of the country and its people, by providing them with services such as roads, potable water, sanitation, schools, colleges, irrigation works, dams, power stations hydroelectric, etc. etc., known as the "human welfare industry". To execute these works, the state needs to perform what is known as Public Procurement, which is necessary to maintain legislation that would allow healthy competition, and that the works are built with quality, lower cost and deadlines, so that the end user can make use of the benefit. In our country, there is the view that public works, lends itself to corruption, which motivates me to undertake a legal study critical of the current public procurement law known as Organic Law of the National Public Procurement System; of its General Regulations and resolutions issued by the entity that the law has designated for this control is the Public Procurement Service SERCOP. He conducted field research with surveys and interviews with study writers, cases and comparative law, present my proposal: INCORPORATE AN EVALUATION SYSTEM AND QUALIFICATION OF OFFERS TO COMPLY principles of legality, FAIRNESS, EQUALITY, COMPETITION AND TRANSPARENCY PUBLIC WORKS CONTRACTS IN THE LOSNCP.
