Тойм:The Constitution of the Republic of Ecuador recognizes the work as a right and a social duty, the constitutional recognition sets the tone for understanding the importance of productive activity in the context of individual development and collective human society. The work today, the emergence of demand related to employment legal relationships between two main subjects, the employer and the employee, whom the Labor Code explicitly tells them their obligations, as well as the prohibitions to be observed as part of a contract. Likewise is the current Labor Code, which establishes the grounds for declaring the termination of the employment contract, however the relevant provisions not cited as a causal, the fact that the employee uses, obtains, uses or submit to third parties information that is solely or domain is the employer. The previous behavior against the principles of loyalty and reciprocity that should exist between the parties involved in labor law relationship also highlight the risk of very important rights violations by employers. Therefore in this work, we study the desirability of the conduct referred to in the preceding paragraph, be included in the Labor Code as a ground for termination of work, so that in this way achieve better protect shape the interests and rights of the employer, which undoubtedly are seriously injured, when a worker unjustly and illegally using information that is of vital importance for the employer. This work is progressing towards the approach of the relevant legal proposal through which seeks to ensure that the worker does not make improper use of information entrusted to him by the employer, and thus also protects the relationship labor law, ensuring that it is always governed by justice, legality, and above all respect and equity between the parties involved in it, ie between employer and employee.
