Necesidad de derogar el artículo innumerado 7 del código de la niñez y la adolescencia, respecto a la pensión de alimentos en caso en que el alimentado y el obligado, convivan bajo el mismo techo

The issue raised and that has been developed in this research work is carried titled as follows: Within the Framework, we found some important issues related to the research based on the concept of society from different writers and also their features, structures, functions and ranking. Moreover it also addresses the issue of the family, its definition, origin, family law, family types and functions, we analyze the minimum household income in regard to the Basic Food Basket and Food Law, to end this chapter with the approach and analysis of concepts such as parent, child, girl, teen, food, maintenance, liability, household spending and good living, all this with the aim to delve to know the highlights which develops and unfolds humans, being important in the present investigation. Later in the Legal Framework discusses important aspects such as: The Right of Food and Family Law enshrined in the Constitution of the Ecuadorian State, the Food Law framed under Ecuadorian law; highlights on the issue of constant food in the Civil Code and the Code of Children and Adolescents, the genesis of the code of Children and Adolescents Ecuadorian as well as a thorough analysis of the Law Amending this. Within the legal framework comprises the analysis of the various international legal bodies which relate to the problem, namely the Universal Declaration of Human Rights Convention on the Rights of the Child, UNICEF, as well as an analysis of the public policy of the country where frame the rights of children and adolescents, such as the government Plan for Good Living and the National Council for Childhood and Adolescence. It also comprises within the legislative framework a comparative study of the Code of Children and Adolescents in our country with those established in the neighboring countries of Colombia and Peru. Within the development of field materials used were surveys and interviews, the methods used were the scientific method, hypothetical deductive method, scientific method, procedures and techniques were: analysis and synthesis which requires legal research proposal, aided theoretical collection techniques as the signing bibliographic or documentary and empirical gathering techniques such as survey and interview. Practiced the field study, we proceeded to compare the results of the implementation of surveys and interviews, and then perform verification of objectives and hypothesis testing, and make the legal grounds for legal proposal. After having completed this research we proceeded to raise our findings and recommendations and proceed to give our proposal to amend the Law Reform Act Title V, Book Two of the Right to Food of the Organic Code of Children and Adolescents (RO 643 July 2009). Concluding with the Bibliography and annexes.
