Aplicación de la pena de trabajo comunitario a los sentenciados por delitos culposos de tránsito con pena de hasta cinco años.

In Ecuador there has been an increase in prison overcrowding, prison massacres and an unnecessary budget covered by the state for persons deprived of liberty. Therefore, there is no social rehabilitation, being indispensable the community work as an alternative to traffic offenses. Methods and materials were applied which allowed the development of the research, interviews and surveys were carried out with legal professionals, judges, lawyers, prosecutors related to traffic matters and also with employees of the rehabilitation center in the city of Loja. The results allowed to propose a legal proposal to the Organic Integral Penal Code, which will have the purpose of incorporating the penalty of community work to those sentenced for traffic offenses with a penalty of up to five years; and thus generate not so drastic sanctions to achieve a good rehabilitation. The study shows that from September 1, 2021 to July 31, 2022 there has been an increase in traffic accidents in Ecuador. According to the penalties established in the Organic Integral Penal Code are very severe for those who commit crimes in traffic. In this case, the driver does not go out into the street to kill, but for any circumstance an accident may occur, which does not warrant being deprived of liberty, but rather that he/she be given an alternative means.
