| Tóm tắt: | As part of the state, its institutions have the primary duty to respect and enforce the rights guaranteed in the Constitution, so that the working relationship between public servants and other groups are often referred to perform their assigned tasks. However, there are other types of relationships that undermine workers' rights. Workplace mobbing is a problem in state institutions and the private entities in which it has majority ownership of public resources, which has a course really worrying in the field of industrial relations in which using his power, destroy the life, family, health and personal dignity as both professional people who - unfortunately - cross his path. In our country there is, as yet, no specific law on the matter, which "constitutes a loophole in the Ecuadorian positive law", thus preventing the victim is covered by various provisions of our legal system. There are no official data on this issue in Ecuador, because this issue not being established by Ecuadorian law, prevents the victim raised his complaint before the courts to enforce their rights and seek appropriate legal protection and are thus defenseless.This thesis shows the most important of mobbing and their devastating for the victim and his family consequences aspects, while the mechanisms used by the stalker to produce is collected, proposing a proposed legal reform to protect public servants. |
