Afegir etiqueta | Sumari: | The present research work entitled "Affectations to the Citizen Security Right and the National Police's Limitation to Use Force" is based on the perspective and analysis of the present situation in the country regarding citizen security, because the country is facing one of the worst insecurity situation, with crimes committed daily and in alarming quantities, including the following: organized crime; the high-level of firearms in possession of citizens; the abuse of narcotic drugs; kidnappings; contract killings; violence against women; violence against children and adolescents; and many other cases that are linked to the difficulties that the criminal justice system and its agencies to investigate and process them. At this point the National Police is involved, which has the constitutional mission to provide citizen security and maintain public order, in addition "the institution is responsible for the protection of the rights, freedoms and guarantees of citizens" according to our supreme charter in Art 158 (Constitution of the Republic of Ecuador, 2008, p. 8). Therefore, through the power of legitimate use of force, it helps to avoid possible damages or threats to legal and/or patrimonial assets of a person. Unfortunately, the laws that regulate the legal use of force have not been capable to reduce the problems that violate the citizens' right to security and the actions of the police officer, which has caused a certain limitation in the actions of the police officer due to fear of the repercussions that this could have, even in the exercise of their functions, this situation has allowed a wave of violence to rise up in almost all provinces. |
