The study carried out, shows that untimely dismissal of the workers substitute alters the emotional stability and physical health of children and adolescents with disabilities, because for this reason, they aren’t being allowed adequate growth and due to their condition, the rights that are proper to children are seen in a state of defenselessness, and, therefore, their best interests of the child are affected, therefore with the present investigation, it’s hoped that a dignified life can be guaranteed to minors with disabilities and reinforced job stability for their parents or legal representatives. In the present titling work, the use and application of materials and methods that allowed its development was made for which surveys and interviews were carried out with legal professionals, whose results served to propose the elaboration of a legal proposal, with the purpose of guarantee the rights of children and adolescents with disabilities to achieve the effective exercise of their best interests, which is being violated due to the dismissal of their parents or legal representatives. |

In the present titling work, the use and application of materials and methods that allowed its development was made for which surveys and interviews were carried out with legal professionals, whose results served to propose the elaboration of a legal proposal, with the purpose of guarantee the rights of children and adolescents with disabilities to achieve the effective exercise of their best interests, which is being violated due to the dismissal of their parents or legal representatives.El presente Trabajo de Titulación se titula: “Análisis jurídico y doctrinario del Principio del Interés Superior de los menores de edad con discapacidad y su vulneración cuando sus padres son despedidos de su trabajo”, y su interés por investigar y realizar un análisis debido a que se evidencia la vulneración del principio del interés superior de los menores de edad con discapacidad al momento en que sus padres o representantes son desvinculados de sus puestos de trabajo lo que provoca consecuencias directas que afectan directamente a estos menores de edad con discapacidad que se encuentran en una situación de doble vulnerabilidad debido a la indefensión de sus derechos que les impide tener un adecuado desarrollo integral. El estudio realizado muestra que el despido intempestivo de los trabajadores sustitutos altera la estabilidad emocional y la salud física de los niños, niñas y adolescentes con discapacidad, pues, por dicha causa, no se les está permitiendo un crecimiento adecuado y debido a su condición, los derechos que son propios de los niños se ven en un estado de indefensión y, por lo tanto se afecta a su interés superior del niño; por ello, con la presente investigación se espera que se pueda garantizar una vida diga a los menores de edad con discapacidad y una estabilidad laboral reforzada a sus progenitores o representantes legales.
