La suspensión condicional del procedimiento en delitos aduaneros y los principios constitucionales de oportunidad y mínima intervención penal

The present thesis takes for title: "The conditional suspension of the procedure in crimes customs officers and the constitutional principles of opportunity and minimum penal intervention", observing like in the penal procedure for crimes customs officers, to the efectivizarse the application of the principles of minimum penal intervention and of opportunity, through the conditional suspension of the procedure, it harms rights of the one processed, because in he/she practices it the one processed it should admit their criminal participation to be welcomed to the conditional suspension of the procedure, being held to conditions that they should complete them. For other the so much thing serious feasible to allow this procedural figure in crimes customs officers where the injured juridical goods are the patrimony of the State. The theoretical, juridical and doctrinal storing, the study of concrete cases, the application of surveys and interviews, he/she allowed to obtain approaches with clear and precise foundations, of very grateful bibliography that you/they contributed to the verification of the objectives and the contrastación from the relating outlined hypotheses to this practice; as much the Constitution as the Code of Procedure Penal tipifican the principles of minimum penal intervention and of opportunity so that they are applied by the procedural parts in crimes customs officers.
