El procedimiento para la adopcion en el ecuador según el código de la niñez y la adolescencia y su necesidad de reforma

This research work we have developed specifically within the legal field in the flaws that exist in the Code on Children and Adolescents, about of that the procedure for adoption is a long process. Currently the adoption is primarily focused on children and adolescents deprived of their family environment; operand and a measure of protection provided by the state and society in favor thereof. Despite this, a number of laws do not limit the figure to the adoption of minors, so that Ecuadorian law through Article 165 of the Code on Children and Adolescents establishes a process of adoption or unregulated establish specific periods in their administrative and judicial phases. What this research seeks to determine is the purpose of adoption with certain time and not the problem that is generated, which in the process becomes chaotic and lengthy process that makes minors for adoption are unprotected and stability of families legally grant them protection and economic and emotional than the natural family could not give it stability . The problem is that it generates no abandoned children find a real family by the administrative and judicial proceedings that are too large and long for causing legal uncertainty adopted and adopters. Therefore we say that adoption is not an option but a vocation as it is intended to start a family with a child or teenager who is in the possibility of being adopted, so the formation of the new family will have security and guaranteed by the State as it has an obligation to protect the core of the society.
