When applying pretrial detention, fundamental principles must be kept in mind since it is a restrictive and exceptional measure that temporarily restricts or deprives the accused person of Liberty while the criminal process is being carried out, which is why pretrial detention is one of the factors that have led to the penitentiary crisis; however, this crisis does not happen suddenly since it is a problem that has been going on for the last few years and has been made invisible. In this degree work, materials and methods that allowed the development of the research were applied, as well as interviews and surveys that were applied to law professionals in order to share their views on the problem, the results obtained allowed to establish and propose a proposal for legal reform in order that pretrial detention is interpreted and applied in exceptional manner. |
