总结: | Marriage is one of the traditional ways to start the formation of a family, because through this link a man and a woman come together in order to live together, procreate and provide mutual help, that's why it is recognized in the Constitution of the Republic of Ecuador, which guarantees the right of all persons to constitute a family. Currently, the Civil Code does not allow the marriage of people between the ages of sixteen and eighteen, even though this is a situation that occurs frequently in Ecuadorian society, this lack of civil regulations generates a violation of the right of these people to create a family and also leave without legal protection both the members of the couple and their descendants, causing a problem of legal order and serious social repercussions, which is the subject of study of this work, which is called: "THE ELIMINATION OF THE MARRIAGE OF CHILDREN OF EIGHTEEN YEARS OF AGE, AND THE CONSENT OR DISSENT OF THE PARENTS IN RELATION TO THE CONSTITUTIONAL RIGHT TO FORM A FAMILY". The research is based on a review of literature based on conceptual, doctrinal and legal content taken from national and international doctrine and legislation and in a field investigation based on the survey and interview techniques whose results allow the process to be carried out. discussion related to the verification of objectives and testing of hypothesis, all the work 5 carried out provides elements to present conclusions and recommendations and to support a legal proposal aimed at reforming the Ecuadorian Civil Code incorporating a legal regime to regulate marriage between persons over sixteen years of age and under eighteen so that they are legally protected; This proposal is presented in the final part of the investigation. |
