The objectives that I have presented are; General objective: Incorporating in the Book, Title, Paragraph of the Civil Ecuadorian Code, a standard that the regulation of the collection of payment of guaranty, by way of leasing enable ; Specific objectives: Determining the existence of this juridical vacuum in the Civil Code; Accomplishing a juridical and doctrinaire study of the rights of the tenants in the Ecuador; Accomplishing a study of field, at Loja's city, to determine the existence of this problems; Projecting an alternative of solution to the above-mentioned problems. In the Revision of Literature, you find yourself structured for: CONCEPTUAL, DOCTRINAIRE AND JURIDICAL FRAME, they developed themes like: Leasing contract; Tell the story of the Contract of Leasing; Definition of the Contract of Leasing; Definition of the guaranty; Tenant's Definition; Lessor's Definition; Definition of Canon; Requirement in order that the contract be valid; Guaranty in the Contracts of Leasing; The Lessor's and the Tenant's Obligations; And, Element of the contract of lease. This investigation is of juridical type, in the one that one utilized methods in like: SCIENTIST; INDUCTIVE DEDUCTIVE; HYPOTHETIC METHOD; STATISTICAL DESCRIPTIVE METHOD and the ANALYTICAL SYNTHETIC METHOD. The information's anthology I accomplish 5 it to him through an opinion poll structured with five questions, in the one that she was diligent to tenants at Commercial premieres of Loja's Downtown, Provincial and Loja's Canton, also an interview elaborated with five questions, to five professionals of the right came true. Los objetivos que he planteado son; Objetivo general: Crear una ordenanza municipal para que permita la regulación del cobro de garantía, por concepto de arrendamiento de los locales que no administra el municipio de Loja.; Objetivos Específicos: Determinar la existencia de este vacío jurídico del cobro de una garantía por concepto de arrendamiento de bienes inmuebles que no administra el municipio Loja; Realizar un estudio jurídico y doctrinario sobre cuáles son los derechos en las que se amparan los arrendatarios en la ciudad de Loja; Realizar un estudio de campo, en la ciudad de Loja, para determinar la existencia de esta problemática; Proyectar una alternativa de solución a la problemática antes mencionada. En la Revisión de la Literatura, se encuentra estructurado por: MARCO CONCEPTUAL, DOCTRINARIO Y JURÍDICO, desarrollaron temas como: El contrato de Arrendamiento; Historia del Contrato de Arrendamiento; Definición del Contrato de Arrendamiento; Definición de la Garantía; Definición de Arrendatario; Definición de Arrendador; Definición de Canon; Requisito para que el contrato sea válido; Garantía en los Contratos de Arrendamiento; Obligaciones del Arrendador y del Arrendatario; y, Elementos del contrato de arriendo. Esta investigación es de tipo jurídico, en el cual se utilizaron métodos 3 como: CIENTIFICO; INDUCTIVO-DEDUCTIVO; MÉTODO HIPOTETICO; MÉTODO ESTADISTICO DESCRIPTIVO y el MÉTODO ANALÍTICO SINTETICO. La recolección de la información se la realizo a través de una encuesta estructurada con cinco preguntas, en el cual fue aplicada a arrendatarios en locales Comerciales del Centro de la Ciudad de Loja, Provincia y Cantón de Loja, también se realizó una entrevista elaborada con cinco preguntas, a cinco profesionales del derecho. Contrastada la información de campo se concluye, que es necesario que se inserte en el Código Civil, Libro IV, Título XXV, Parágrafo 1°, un artículo referente a la regulación el cobro de garantía por concepto de arrendamiento. Con el fin de que los arrendatarios tengan más facilidades al arrendamiento de cosas o bienes, y que no se vulneren sus derechos por este vacío jurídico existente. En el estudio de caso, en la entrevista y la encuesta obtuvimos que el cobro de garantía por concepto de arrendamiento en el Ecuador, es un problema social que se viene dando frecuentemente, por el hecho de que los arrendadores de manera unilateral y sin regulación alguna de la ley, ponen un capital determinado por ellos mismos de garantía por la cosa que se arrienda.
