| Zusammenfassung: | The Constitution of the Republic of Ecuador, as a fundamental rule within our territory, it recognizes a series of rights, obligations and responsibilities with regard to the family, by both the Constitution being a general rule, our authorities have a responsibility to dictate the secondary rules that allow to enable the mandates that the Constitution enshrines. The Ecuadorian Civil Code with regard to the divorce and the legal status of children is very broad and does not allow you to protect effectively the rights of children, on the contrary our civil legislation makes it impossible for divorced parents share custody of the children, the procedural way to be followed, in cases of divorce in our country, produces a fear in both parents of losing the children and then a frustration can hardly be equated with the sentencing the break not only of the family, but of the marriage, by granting the judge custody to one parent at the expense of the children and the other parent. Within the Civil Law, the institution that has suffered deep legal developments it is precisely the family, in this sense, the country needs a rules to establish and regulate family relationships between parents and children after a divorce that provides for the procedures for the exercise of such protection and compliance whose purpose is to preserve family relations between parents and children. |
