Description
Summary:The theme that I decided to develop called so I"LACK OF COORDINATION AND COOPERATION BETWEEN THE ORDINARY JURISDICTION AND INDIGENOUS JURISDICTION IN ECUADOR" would make the summary. This research work, aims to analyze the conceptual, doctrinal, and legal status of the Constitution of the Republic of Ecuador regarding the rights of communities, peoples and nationalities. This research work aims to incorporate in legislation a law Ecuadorian Coordination and cooperation between indigenous justice and ordinary justice, due to the many problems that have arisen nationally related to the violation of legal principle of double jeopardy, because the double jeopardy of an act by the indigenous justice and ordinary justice, resulting in a violation of the rights of people, so it is necessary to coordinate in any way the legal pluralism that occurs, and for this I think our country must contain a Coordination and Cooperation Act, which becomes the content of the implementing rules of both indigenous and ordinary justice. From the above I believe that by studying the structure of our current legislation, and the absence of a sufficient legal body, in order to avoid internal conflicts and damage to the rights of individuals, after analyzing the consuetudario right of peoples and communities indigenous as well as about the characteristics that surround indigenous justice within their own worldview, they may make a viable legal proposal that contributes to improving the legal regulations of our country and, above all in their application considered safeguard the security of people and, of a state constitutional human rights and social justice in our country.
