| Sumari: | The accountability in the context of the philosophy of modern criminal law is determined in strict consistency with the powers of will and conscience of the offender, so that will be responsible for the crime to the extent they acted in the exercise of free will, which is not occurs precisely with people who commit a crime in a serious state of mental exaltation effect of a violent emotional shock. That's when the call occurs crime of passion, which, given its nature and the conditions of accountability that he observed, has aroused the curiosity of students of Criminal Law and Criminology, leading to heated debates about the criminal responsibility of perpetrator of those offenses. In this study we analyze a very careful regarding violent emotion in mitigation of criminal responsibility, accountability starting study under our Criminal Code, as well as the circumstances of the offense and accountability in the Penal Code of Ecuador, and relating those to the reality of crimes of passion in the national, without neglecting the study of victimology look at the crime in a state of violent emotion, as well as the manifestation of gender that have this type of crime , determining specifically as would affect the state of violent emotion, which undoubtedly affects the will and consciousness (knowledge) the offender, in terms of accountability in the context of our criminal law. This project is complemented by a legal reformProject designed to suggest an alternative to regulate violent emotion as triggering circumstance of the offense that affects the will and conscience of the individual offender. |
