সংক্ষিপ্ত:he agricultural sector is one of the most influential in Ecuador, it represents an important item in the country's economy, the work of the agricultural sector is generally made up of a large percentage of small producers, whose income from productive activity allows them only for family support and sometimes small surpluses that they share in solidarity with family and friends; and another is sold to recover part of the production costs, so the legislation that regulates agricultural production activities and practices should take into account the current reality of the agricultural sector, with the aim of analyzing the disproportionality of the sanctioning regime in the Organic Law of Agricultural Health, the law regulates the health of primary production and the safety of food, however the sanctioning regime applies sanctions without making a distinction of the production ranges, that is, small, medium and large-scale; therefore, it is disproportionate to impose excessive pecuniary fines on small and medium producers, whose income comes from their production or from a certain productive unit, which is used for self-consumption and economic sufficiency in relation to production. The survey technique, interview and, most importantly, the study of cases related to the Organic Law of Agricultural Health and its sanctioning regime were used. Sanctioning small producers with fines disproportionate in relation to the production range, represents a considerable impact on their family finances, which, without fear of being wrong, results in mistrust in the justice system. The need for 3 a distinction between producers was evident so that the imposition of sanctions is proportional and in accordance with the provisions of the Constitution of the Republic of Ecuador, with respect to the principle of proportionality.
