Reformar la Ley de Compañías, estableciendo normas adecuadas para implementar las medidas precautelatorias en el derecho societario

The precautelatorias measures have become the most appropriate means by which a person or a certain people may be right that can be violentarlo ignore or guaranteed. This research is titled: "REFORM ACT OF COMPANIES SETTING STANDARDS APPROPRIATE MEASURES TO IMPLEMENT PRECAUTELATORIAS IN CORPORATE LAW". The same one that addresses the issue of the need to incorporate clear and appropriate rules regarding the precautionary measures in corporate law since, the lack of established rules seriously harms those who wish to assert their rights in the legal field. The hypothesis that I lead is you work research was: Need to implement precautionary measures within the corporate law, because the lack of legal regulations and established the implementation of these measures create an environment of legal uncertainty that violate rights people. The processes used were hypothetical, inductive - deductive method, analytical explanatory, statistical; for the preparation of the descriptive analysis method was used. The techniques were applied was the interview 5 lawyers working in legal clinics and their survey of 30 practitioners in the free exercise of the city of Loja, through the instrument consisted of a series of questions designed to elicit relevant information. Among the outstanding results we have through the study and legal and legal analysis of the issues raised, it is shown that there are flaws in the law, in regard to the proper regulations regarding precautionary measures in corporate law.
