Sažetak:This research work I have developed in the legal field of public law, specifically the weaknesses that exist in the Labour Code concerning the right holiday for workers. Workers are a social group that has been subjected to discrimination and / or marginalization throughout our history, which is why today the State to each and every one of its members must contribute to enforce their rights, especially in the framework of equality and encouraging nondiscrimination toward this important social sector, a cornerstone of economic development. When referring to annual leave received by workers, let me say that I consider this holiday period insufficient since, workers have more than earned the right to make use of an annual holiday period of thirty days equal to the one for public servants. In addition, our Constitution as a principle of immediate application, states that all people are equal and enjoy the same rights, duties and opportunities, no one shall be discriminated against for any distinction, personal or collective, temporary or permanent, which has the purpose or effect impairing or nullifying the recognition, enjoyment or exercise of rights
