The article 81 of the Constitution of the Republic of Ecuador states that "The law will establish special and expeditious procedures for prosecution and punishment in crimes of domestic violence". Being a priority group require an intervention fast, effective, and timely by the court regarding the penalty and prosecution of these crimes of domestic violence. The violence against of women or members of family is a social trouble between the history, plus the large number of complaints and their impact and impunity for crimes of domestic violence in our country currently, so a solution to the problem is necessary, through the establishment of a special procedure that guarantees respect and effective protection of the rights of victims of domestic violence regarding the prosecution and punishment of these crimes of violence against women or members the family. ~ 5 ~ For this trouble, this research was conducted, it has been possible to have enough bibliographical material and criterion contributing authors to complete the review of literature and techniques of both the survey and the interview that helped me to achieve favorable for tabulation of field research results, information was collected processed and analyzed them that allowed me to verify the objectives and the hypothesis, also arrived in the conclusions, recommendations, and proposed amendment to the code Organic Integral Penal. |
