This research is topical and importance with which it was found that there is a serious violation of the rights of nature embodied in the Constitution of the Republic, in the fact that is abandoned pets, although this is punishable as an offense in the Code of Integral Penal. So, this research is aimed to study the problem and propose a proposal that would facilitate a solution, based on the analysis of the Constitution of the Republic of Ecuador is evidenced clearly that the rights of animals are guaranteed full rights of nature, therefore the C.O.I.P. paragraph is only contravention of abuse and death of pets or companion animals "Article 249. Abuse or death of pets or companionship.- the person who by act or omission causes harm, cause injury, damage to physical integrity of a pet or pet animal shall be punished with fifty to one hundred hours of community service. If the animals death is caused it shall be punished with imprisonment of three to seven days. "But it has not established any penalty for people owners of these pets who deliberately abandon generating a danger to society because many times these animals are angry and other contagious diseases generating uncertainty in society. 5 Many pet’s owners presenting inconveniences of living with the animal, family, social problems, among others, opt for abandoning them without taking into account the animal will suffer and die on the streets. It is not just a social but also health problem that afflicts more often our lives. Every day there are animals abandoned in the streets and parks. And the figure is increasing every year generating a danger to society. |
