| Özet: | This research paper entitled “The dissemination of personal data affecting private life: the right to be forgotten to limit and control”, addresses a problem in the Ecuadorian judicial system highlighting the risks and challenges associated with indiscriminate exposure of personal data on public platforms, in this sense, can have negative consequences for individuals involved in court cases. In particular, this paper focuses on the right to be forgotten, which consists of deleting lawful but obsolete or irrelevant information in the digital environment, especially in public platforms where information is accessible and visible, such as the Ecuadorian Automatic System of Judicial Processing (SATJE) and Crime Consultation of the Attorney General's Office (FGE). This right, recognized in several legal and jurisprudential contexts, has emerged as a response to the challenges posed by the indefinite permanence of certain personal data even after they have lost their relevance to society. This right guarantees that personal public information is not used in an improper or harmful manner, preventing the transgression of fundamental rights established in the Constitution of the Republic of Ecuador. The use of methods and techniques such as interpretation of texts, legal norms, interviews and surveys has provided a solid basis for contextualizing the subject within the relevant legal framework. In the same way, the objectives set are resolved and verified, concluding with guidelines and proposals to the competent authorities, in order to reinforce the right to legal certainty. |
